^How the K1 Visa Process Works:
To bring a future spouse to the USA, a U.S. citizen must first file a K-1 Visa petition in the United States with the Department of Homeland Security. Once the petition is approved, the petition is then forwarded to the United States Consulate in the country where the foreign fiancée resides. The U.S. Consulate will then contact the foreign fiancée and set up an interview date shortly thereafter. K1 Visas.
Prior to the interview, the foreign fiancée will be required to have a medical exam. In most cases, the medical exam can be scheduled a couple of days ahead of the interview. The fiancée attends the interview, and a visa will be issued within 1-3 days, depending on the specific country. After receiving the K1 visa, the foreign fiancée has up to six months to exercise the use the visa to travel to the USA.

Arriving in the USAOnce the foreign fiancée arrives in the USA, he/she must marry the U.S. Citizen within 90 days or they will be required to return to their country of origin. After you marry, you must then file for the I-695 adjustment of status. After filing for the adjustment of status, your fiancée will be allowed to work usually within 90 days.Permanent residency can take between 1-2 years. If for some reason the relationship fails before permanent residency is granted, there will be no other options for adjustment of status and the K1 spouse in most cases will be required to leave the USA.
K1 fiancée visa holders are in valid status for only 90 days after U.S. entry, and may not extend their status. K2 ChildrenIf your foreign fiancée has children under 21 years of age, and will not turn 21 years old prior to the K1 visa interview, they can be included on the same visa petition with their parent and obtain a K-2 visa. The K-2 visa will allow the children to accompany their parent to the USA. Travel Outside the USA After MarriageYour spouse can apply for permission to travel outside of the USA at the very same time as you file for the adjustment of status. This is called Advanced Parole. Advanced parole can usually be obtained in 90 days after you file.
Note: Your spouse must obtain advance parole before any travel outside of the USA, or he/she will not be allowed re-entry. In that event, you would then have to file a spousal visa petition in order to allow your spouse to return to the United States.

How the K3 Visa Process Works:
If a U.S. citizen marries a foreign citizen abroad, the U.S. Citizen must return to the USA and file a Spousal Visa Petition. In such cases where the marriage took place while the foreign citizen was in the USA, the foreign citizen must observe the rules of the visa they used to enter the USA and return to their country, awaiting approval of the spousal visa petition. K3 Visas.
The K3 visa petition is a two-part process. The U.S. Citizen must first file an I-130 application with the USCIS Service Center representing the state where the applicant resides. When the U.S. citizen receives the receipt notice for the first application, an I-129F application must be filed with the Chicago Service Center.

After Approval of K3 PetitionAfter approval, the application will be forwarded to the National Visa Center. The rest of the K-3 process can be very confusing to many people, thanks to the way it was designed. If the I-129F is approved first, the application will be sent directly from the National Visa Center to the Consulate in the country of the foreign spouse. The process then works much like the K1 fiancée visa process, and an interview will take place in a reasonable amount of time. In the event that the I-130 is approved first, the National Visa Center will contact the U.S. Citizen asking for more fees to complete the processing. This usually results in a delay of about 2 months before the approved petition is forwarded to the U.S. Consulate.SummaryWe will be happy to assist you with the visa of your choice. The K3 visa currently takes longer than the K1 Visa, and it is more expensive to prepare. There is more paperwork involved than the K1, and there are more government fees as well. If you are already married, the K-3 is the visa that you will need to file. If you are not married, and there really is no reason to get married until your loved one travels to the USA, then the K1 Fiancée Visa is really the best option. Many services will try to talk people into the K3 Spousal Visa because they can make more money.
